Bilingual Law Firm

Nurse cuts off infant's pinky finger

Monday, November 28, 2012

A Polk County nurse who was trying to remove an IV from a 3-month old baby accidentally snipped off part of the girl's pinky and now the family is suing the nurse and the hospital.

Veronica Olguin is scheduled to appear at a news conference on Wednesday after hiring the Orlando-based Pendas Law Firm to represent her. Olguin said a nurse at Heart of Florida Regional Medical Center in Polk County cut off her daughter's finger with a pair of scissors.

She just turned really red. She started screaming. I just remember (my daughter waving her hand)," said Olguin, who added that the incident still haunts her.  "I wake up and everything comes back to my mind and I just wake up crying.  Sometimes I can't go back to sleep because of the thought of it. "Olguin said that there's nothing the nurse, Emily Anna Stutz, can say or do. "All she ever said to me was 'I am sorry, I have children too,'" Olguin said.

The hospital on Tuesday released a statement about the incident. "An unfortunate accident occurred at our hospital while an experienced nurse was removing bandages from the tip of a child's finger. We rushed the child to a hand specialist, but unfortunately the tip of the finger could not be reattached. We deeply regret the harm to the child and want to express our compassion and concern for her and her family," the hospital said in a statement. The incident happened in October, but Olguin's attorney, Lou Pendas, said his firm has not been able to come to an agreement with the hospital. He said communication began with the hospital after the incident, but since then, all communication has stopped. "We reached out right away to the child's family and their attorney, but have not been able to reach a mutually agreeable resolution. Again, we want to reiterate our sincere concern for the child and her family," the hospital said.

Pendas said it's too early to say what kind of compensation they are looking for, but according to the lawsuit records, it labels damages exceeding $15,000. "I don't want this to happen to another kid," Olguin said.

1,000 Frozen turkeys donated by law firm

As in years past, the turnout was tremendous as was the joy shown by those who showed up to receive one of our Butterball turkeys. We at the Pendas Law Firm are thankful to be a part of these communities and hope that we helped to add to the celebration of Thanksgiving for many families this year.

Hundreds of families received a turkey for Thanksgiving

Thursday, November 24, 2011

November 20, 2010: In a gesture of solidarity with the community, Attorney Lou Pendas and the offices of the Pendas Law Firm gave away free turkeys to hundreds of appreciative locals. Lou Pendas had the opportunity to interact with the large crowd and several media representatives congregated at 5237 Commons Boulevard in Fort Myers.

For Mr. Pendas, it was his first opportunity to shake hands with members of the community who expressed overwhelming praise for the members of the Pendas Law Firm. The firm’s staff arrived before dawn accompanied by a trailer full of one thousand top-quality turkeys. Mr. Pendas personality and heart were clearly on display as he and his sons Gabriel (11) and Daniel (9) helped distribute the Thanksgiving turkeys.

The marathon continued the next morning in Tampa and then the following day in Orlando to complete the give-away of three thousand turkeys in total. “On behalf of all families in need in Southwest Florida, we thank the attorney Pendas and hope that God continues to bless him and his family,” said Stephen Murial, a resident of Ft. Myers after receiving a hug from the host. The Pendas Law Firm represents individuals who have suffered an accident and represents them from offices in Fort Myers, Tampa, and Orlando.

The Pendas Law Firm has begun listening and talking to our Southwest Florida community. I visited their new office at 5237 Summerlin Commons Boulevard in Fort Myers to give Mr. Pendas the opportunity to “present his credentials” to the community and he gladly gave us an interview.

Born in Cuba and raised in Central Florida, Lou Pendas graduated from St. Thomas University School of Law in 1996 and was accepted to the Florida Bar in 1997. Since then, he has devoted his practice to personal injury, auto accidents, wrongful death, slip and falls, and defective products.

Early on in his legal career, Mr. Pendas opened his own firm, The Pendas Law Firm, which has expanded into markets with high concentrations of Hispanics. Frequently Asked Questions

How long will it take to resolve my case?

This really depends on what kind of case you have, how seriously you are injured and who is being sued for your injuries. Some simple car accident cases can reach settlement in as little as four months. Some complex wrongful death cases can take years, with an investment on our part of hundreds of hours of work and tens or even hundreds of thousands of dollars. Many times, the more your case is worth, the more of a fight the person who is being sued will put up.

Do I have to go to trial?

The short answer is no. Most cases are settled without having to file a lawsuit, or what we call, litigation. We sue defendants in court only when it is the only way to achieve a fair settlement, and we prepare our cases as though they are going to trial. But before going to trial, we will thoroughly explain all your options and help you make the best decision for you.

What is “mediation”?

Before allowing us to go to trial, the Courts in Florida will make both parties attend mediation. Mediation is an informal settlement conference, where you and one of our lawyers get together with the lawyer and defendant (or insurance adjuster) from the other side to try and reach a settlement. A mediator is a lawyer, hired by both sides (we each pay half the fees for the mediator) to try and help reach an agreement. The mediator is not a judge and does not have the authority to compel an agreement like an arbitrator. He or she is there to help the sides communicate and compromise. As the client, you don’t have to do anything except listen and decide if you want to settle. Many of our cases scheduled for trial settle at mediation.

If we settle, how much of the settlement will I get?

That really depends on how much your medical bills are and how much we had to spend to get the case settled. Once we have to file a lawsuit in court, our percentage of the total settlement goes up from 33.3 % to 40% of the total settlement. After that, our costs and your medical bills get paid from the rest of the settlement. Whatever is left is yours, and we try to make sure you know just how much you have coming to you before you agree to settle.

Will I be responsible for any costs if we lose at trial?

No. In personal injury matters, the Pendas Law Firm pays all the costs, including filing fees, experts, and discovery costs up front. If we successfully settle your case, or win at trial, we recover our costs out of the settlement or award from a jury. If we are not successful in either settling your case or winning at trial, you will not be responsible for any costs.

Joel L. Piedra is a senior associate and manager of The Pendas law Firm Orlando office. He joined The Pendas Law Firm in 2009.

Mr. Piedra is experienced in Personal Injury and Products Liability cases. He dedicates his practice to helping accident victims get a firm understanding of the legal process and their individual cases and assists clients in obtaining the maximum value for their claims either through settlements or trial.

Prior to joining the Pendas Law Firm, Mr. Piedra worked as an Assistant State Attorney for the North Judicial Circuit trying numerous cases involving felonies and misdemeanors. He continued to sharpen his trial skills by working for one of the top criminal defense law firms in Central Florida. In 2005, Mr. Piedra moved to Miami and commenced his career as a civil trial lawyer working in the personal injury defense field.

Mr. Piedra received his JD from Stetson University College of Law. He received his BA, with honors, from the Florida State University. Mr. Piedra is admitted to practice in Florida and in the U.S. District court for the Middle District of Florida. Mr. Corzo was born in Chicago, Illinois and was raised in Seminole, Florida. Mr. Corzo attended Seminole High School and the University of South Florida in Tampa where he earned a Bachelor of Science degree in Political Science in 1998. Mr. Corzo attended law school at the New England School of Law in Boston, Massachusetts and earned his Juris Doctor degree in 2002. Prior to being part of The Pendas Law Firm, Mr. Corzo formed Corzo & Kohrs, P.A., Mr. Corzo worked for John H. Thompson IV, P.A. in St. Petersburg, Florida where he practiced personal injury, social security disability and workers’ compensation. He is also a former assistant public defender for the Office of the Public Defender for the Ninth Judicial Circuit where he handled thousands of cases ranging from simple traffic matters to complex felony cases such as drug trafficking, robbery, burglary, home invasion and sex crimes.

Luis Toribio is an Associate Attorney at the Tampa office of the Pendas Law Firm. He was born and raised in New York City, New York. Mr. Toribio earned his Bachelor of Arts degree in Legal Studies from the University of Central Florida and earned his Juris Doctorate from Florida Agricultural and Mechanical University College of Law in Orlando, Florida. During law school, Mr. Toribio was actively involved in advocating on behalf of his colleagues by serving as the 2L Representative of the Student Bar Association, Vice President of the Entertainment Art and Sports Law Society and Treasurer of the Hispanic American Law Student Association.

It makes more sense to think about PIP insurance as health insurance, rather than automobile insurance. PIP is insurance that pays your medical bills like health insurance when you are hurt in an automobile accident. It doesn’t matter if it was your fault or not (that’s why it’s also called “No-Fault Insurance").

It doesn’t matter if you are driving, a passenger, in your car or someone else’s. It doesn’t even matter if you are walking or on your bicycle. If you are involved in an accident with a car, your PIP insurance pays your medical bills.

There are some limitations you need to know about. Most people have a deductible of $1000 on their policy. If you do, you are responsible for the first $1000 worth of bills. PIP insurance usually pays for 80% of all the bills after that, up to a total of $10,000. That means you have to cover 20% of the bills. Typically, if you use up all of your available PIP coverage, you will end up owing about $3000. If you were not at fault, and the person who is at fault has Liability Insurance, then we can help you recover that money from them.
