Alabama Family Threatens Lawsuit Against Disney For Snake Bite
The family of an 8 year-old boy bitten by a snake at Disney’s Animal Kingdom is threatening the company with a lawsuit after the boy’s great-grandmother died from cardiac arrest when she witnessed the animal attack. Lawyers for the family claim the snake escaped its enclosure at the park and was allowed to enter an area open to the general public.
The snake fell from a tree, according to reports, and bit the young boy in front of his great-grandmother. The boy survived the encounter but the elderly woman allegedly began to suffer from breathing problems and ultimately died from cardiac arrest a day later.
Disney representatives confirmed to news outlets the snake attack took place in October 2014 but that the snake was not a specimen at Animal Kingdom but was instead a wild snake. Despite Disney’s assertion the snake was not part of the park’s attraction, the family’s lawyer plans on filing a formal lawsuit against the company and investigating whether or not Disney may be liable for negligence and premises liability.
Orlando premises liability lawsuit
Under Florida’s tort laws, injury victims able to prove their injuries were the proximate cause of negligence or premises liability on the part of a property’s owners or management company may be entitled to compensation for their damages. Recoverable damages include lost income, hospital bills, pain and suffering, and other damages.
Common premises liability injuries may include slip and falls, industrial accidents, head and neck injuries from falling debris and other similar accidents. The Pendas Law Firm strongly encourages injury victims seek immediate medical attention to document their injuries and being treatment.
The law holds property owners must take reasonable steps to ensure premises open to the public or invited guests do not put visitors at an undue or foreseeable risk for injury. Actions to ensure this may include providing adequate security, making necessary repairs, and posting signage as to hazardous conditions as they become aware of the situation.
