Tampa Product Liability Lawyer

Not many people worry about falling victim to a severe or disabling injury within the comforts of their own home. However, hundreds of thousands of Americans become injured by everyday household products every year. These items range from kitchen appliances to computers, cars, and children’s toys. Even yo-yos cause injuries. According to analysis done from 2002 to 2006 by the Consumer Product Safety Commission (CPSC), there were 416 “incidents” involving yo-yos, 19 of which necessitated medical treatment. Contact our experienced Tampa product liability lawyers for more information or help. According to Yahoo News, which used CPSC-gathered-data, the household products that cause the most number of injuries every year as as follows:

  • Porches and balconies cause 120,989 injuries and 54 deaths each year;
  • ATVs cause 121,371 injuries and 178 deaths each year;
  • Garden tools, excluding mowers, cause 122,951 injuries and 83 deaths each year;
  • Ladders and stepstools cause 131,389 injuries and 35 deaths each year;
  • Chemicals cause 152,074 and 66 deaths each year;
  • Pools and hot tubs cause 152,074 injuries and 66 deaths each year;
  • Plastic containers cause 69,605 injuries and 48 deaths each year
  • Power tools cause 196,361 injuries and 33 deaths each year;
  • Showers and bathtubs cause 228,673 injuries and 169 deaths each year;
  • Playground equipment causes 234,093 injuries and 14 deaths each year;
  • Non power tools cause 245,120 injuries and 34 deaths each year;
  • Doors, not counting garage doors, cause 278,082 injuries and nine deaths each year;
  • Walls and ceilings cause 320,033 injuries and 84 deaths each year;
  • Beds cause 406,817 injuries and 274 deaths each year;
  • Chairs and couches cause 415,811 injuries and 187 deaths each year;
  • Knives cause 427,173 injuries and 19 deaths each year;
  • Other furniture, excluding beds and chairs, cause 578,704 injuries and 114 deaths each year;
  • Bikes, trikes, and unicycles cause 610,188 injuries and 361 deaths each year;
  • Carpets, rugs, and other flooring cause 939,673 injuries and 972 deaths each year; and
  • Stairs cause 1,129,475 injuries and 329 deaths each year.

However, not all of those injuries and fatalities are the fault of the product, or, more accurately, the fault of the designer or manufacturer. Instead, many of those injuries and fatalities are solely the fault of the victim. But not all. Thousands of people that use products in a responsible, reasonably safe manner fall victim to serious injuries due to faulty products. These unsafe products cause injuries due to poor design or poor manufacturing, and the negligent party responsible for the design or construction should be held accountable. In order for a successful products liability lawsuit, it must be proven that the victim was using the product as intended and in a fashion that an ordinary person would after reading any warnings that came packaged with the product. Just because a person cuts themselves on a knife does not give them the right to sue the company that designed it, obviously. However, if they were using a newly purchased knife as intended and, during a normal chop, the handle fell apart and they severed a tendon, the company may be held liable for creating a faulty product.
