Family Files Lawsuit Against City, Vendor In Fort Lauderdale Moon Bounce Accident

The family of a young girl injured when the moon bounce she was playing was lifted during a tornado recently filed a lawsuit against the vendor who set up the attraction and the city of Fort Lauderdale, alleging negligence on the part of both entities. The girl’s parents claim that in addition to the bump on her head which caused her to spend the night in the hospital, the child has behavior issues and difficulty concentrating in school due to the accident.

The accident took place on Memorial Day 2015 when the moon bounce was lifted up to 20 feet in the air by gusts of winds that topped out between 65 to 85 miles per hour. A total of three children were inside the moon bounce when it was lifted off a concrete basketball court where it had been set up.

All three children were treated for cuts and scrapes. One of the other children suffered a fractured wrist and another a broken arm. The child at the center of the recently filed lawsuit told reporters she feared for her life as she tossed and turned inside the inflatable structure.

Suit alleges negligence against city and vendor

Up until now, all three families of the children trapped in the moonbounce had been negotiating with the vendor that set up the structure in the hopes of reaching a settlement. The personal injury lawsuit levies several claims against the vendor and the city for what the plaintiffs believe to be negligent behavior.

Counts of negligence against the moonbounce vendor include:

• Allegations the vendor was negligence in the structure’s assembly;
• Failure to monitor weather conditions;
• Negligent training of its employees to handle emergencies; and
• Failure to warn patrons of the dangers posed.

The plaintiffs argue the city bears responsibility for the incident as well. The lawsuit claims the city owed patrons a duty to provide a safe environment, was negligent in placing the moonbounce on the concrete basketball court, failed to test the structure in inclement weather, and provided improper supervision of the vendor’s operations.
