Just because you are entitled to $10,000 in PIP doesn’t mean you’ll see that money, as it typically goes to the doctors. You should call the insurance company and reserve $5,000 for lost wages. Our attorneys deal with lost wages all the time. A hospital will have claim on $5,000 of PIP, and may get the full amount from the hospital bill. If you are unable to work, have your doctor write a note explaining that you are unable to work for six weeks. It must be documented that you cannot work, as the defense will ask where the proof is in order to convince the jury. You must document everything and have a doctor back you up. Make sure your employer knows as well, because this will help us in front of the jury. If it doesn’t exist in the medical records, we will not be able to prove it. Just because a doctor described a need for surgery, if it is not in the records, then it didn’t happen.
