Family Of West Palm Beach Man Killed At Sewage Treatment Plant Files Wrongful Death Lawsuit
The family of a man who drowned in a sewage treatment tank at the East Central Regional Water Reclamation Facility recently filed a wrongful death lawsuit against the cities of city of West Palm Beach, Riviera Beach, Lake Worth, and Palm Beach. The suit claims the man’s death could have been prevented had safety recommendations been followed.
In January 2015, the deceased fell to his tragic death through a corroded section of a metal grate covering the top of a sewage treatment tank. After he was reported missing, plant workers spent hours looking for the victim, draining pipes and tanks in a frantic search.
Perhaps the most senseless aspect of the case is a report by inspectors denoting the dilapidated condition of the metal grates which the deceased fell through. According to the lawsuit, plant inspectors knew of the potentially dangerous conditions plaguing the water treatment facility yet failed to act in a responsible manner to prevent injury or death.
The specific amount of money sought in the suit was not disclosed. The family’s lawyer hopes the wrongful death lawsuit with help prevent another tragedy like the one that befell the victim. The deceased is survived by his sons and wife.
Complicating the suit are Florida’s state workers’ compensation laws. The laws limit the amount of money a family may file an insurance claim with the employer for in the event of death or serious injury at work.
