Medical Malpractice is the failure for a physician to use the acceptable standards of care.
The problem with a Med Mal action is there is medical negligence that doesn’t necessary point to a severe enough injury for us to prosecute. We have to comprehensively review the documents, an affidavit signed by a physician or specialist; and series of records leading to an injury causing damages.
The client should not make the determination that the injury is significant enough. We need to know client’s damages, future problem, and possibly a need for surgery.
